1. Definitions
In these Terms and Conditions:

- "You" and "your" refer to any individual or entity using our services as described below.
2. Our Services
At ReclaimWise UK Ltd, we provide assistance in submitting self-assessment tax returns to HMRC to help you reclaim potential tax relief.
2.1 Submitting Your Self-Assessment Tax Return
Using the information you provide, ReclaimWise UK Ltd will assess, calculate, complete, and submit the necessary forms to HMRC on your behalf. If HMRC requires a self-assessment and determines a tax liability instead of a refund, ReclaimWise UK Ltd will calculate the amount owed, inform you of the liability and due date, and submit your return accordingly.
2.2 Handling an Enquiry from HMRC
If HMRC initiates an enquiry into your tax return, ReclaimWise UK Ltd will gather the required information from you and respond to HMRC’s queries until the enquiry is resolved. If we submitted your tax return, we will manage the enquiry at no extra charge. Direct any correspondence from HMRC to ReclaimWise UK Ltd.
2.3 Tax Code Adjustments
After your tax return is submitted, your tax code might change. If you notice an increase, contact ReclaimWise UK Ltd to have it adjusted. We will automatically remove any employment expenses added by HMRC to your tax code to prevent underpayment if your circumstances change.
3. Our Obligations
3.1 Processing Information
We will process the information you provide promptly and accurately. The average processing time is 8 to 12 weeks, with potential delays due to HMRC security checks or other factors. This timeline starts once we have all the necessary information from you.
3.2 Late Filing
If you file your return late and incur fines from HMRC, you will be responsible for paying them, unless the delay was caused by ReclaimWise UK Ltd. In such cases, we will appeal the penalty and, if unsuccessful, cover the fine.
3.3 Maintaining High Standards
We adhere to high standards of conduct and may decline to provide services if it risks breaching these standards. We will notify you promptly if we decide not to provide a service.
3.4 Responsibility for Incomplete Information
If you do not provide all the necessary information, ReclaimWise UK Ltd cannot be held responsible for the outcome of your tax return.
3.5 Responsibility for HMRC Delays
ReclaimWise UK Ltd is not liable for delays in tax refunds caused by HMRC’s procedures and security checks.
4. Your Obligations
4.1 Cooperation
You agree to cooperate with us to enable the provision of services.
4.2 Providing Accurate Information
You agree to provide accurate, complete, and truthful information promptly.
4.3 Submitting Complete Information
You agree to provide all relevant information for the tax years in question. If incomplete information prevents timely submission, you will be responsible for any resulting late filing penalties.
4.4 Keeping Accurate Records
You must keep accurate records such as receipts and bank statements. We cannot process cash-only expenses without receipts.
4.5 Disclosing All Income
You must disclose all sources of income and provide honest details of expenses.
4.6 Repayment of Incorrect Claims
You accept responsibility for repaying any refunds based on incorrect information and cannot claim any fees from ReclaimWise UK Ltd unless we made an error.
4.7 Ensuring No Outstanding Debts
To proceed with your claim, you must have no outstanding debts with HMRC and must not be under an Individual Voluntary Arrangement (IVA) or bankrupt.
5. Our Fees
5.1 Fee Deduction
Our fee will be deducted from your refund when received from HMRC. If there is no refund and you owe HMRC, we will confidently charge for the services provided.
5.2 Standard Fees
Our standard fee is 30% plus VAT for any refund we obtain for you.
5.3 Cancellation Fees
If you cancel after we have received your UTR number, a minimum fee of £250 plus VAT per tax year applies. No fee is charged if the UTR number has not been received.
5.4 Support During HMRC Enquiries
For HMRC enquiries, you must provide the necessary information. If not provided, the expected fee will still be charged.
5.5 Unauthorized Use of Calculations
You cannot use our calculations for your own submissions or fraudulent claims. We will seek payment for unauthorized use.
5.6 Handling Direct Refunds from HMRC
If HMRC sends your refund directly to you, we will invoice you for our fee and pursue payment if necessary.
6. Handling Your Refund
You authorize us to receive and process your tax refunds. We will deduct our fee and promptly forward the remaining balance to you.
7. Data Protection and Money Laundering
7.1 Data Protection Compliance
We are registered with the ICO for Data Protection (registration number: ZB698409) and comply with strict security measures to protect your personal information.
7.2 Use of Personal Data
Your personal data will only be used to provide our services.
7.3 Data Storage
We will securely store your documents for three years and then destroy them according to security standards. You may request the return of your documents within this period.
7.4 Monitoring Communications
We may record and monitor communications for training and quality purposes.
7.5 Contact Consent
We may contact you using the provided details. You can opt out of receiving information about offers or services by contacting us.
7.6 Maintaining Confidentiality
We will not share your details with anyone outside of Reclaim Wise Ltd without your consent.
7.7 Money Laundering Compliance
We comply with the UK’s Money Laundering Regulations (registration number: XBML00000199908) and will require identification documents to provide our services.
8. Complaints
8.1 Handling Complaints
If you have a complaint, contact our staff promptly. If unresolved, follow the complaints process below.
8.2 Complaints Process
Email complaints to info@reclaimwise.co.uk, providing your name, contact number, and address. Our complaints department will respond within 2-10 working days and attempt to resolve the issue. We will confirm the resolution and closure of the complaint once it is resolved.
9. Termination of Contract
We may terminate our contract and seek compensation if:
- We are unable to continue acting for you.
- You do not provide clear instructions.
- We believe the claim will not be successful.
- You provide misleading information.
- You fail to make payment within 14 days of our reminder.
10. Legal Jurisdiction
These terms are governed by English law. Consumers can bring claims in English courts or the courts of their residence in Wales, Scotland, or Northern Ireland. We may also claim against you in the courts of your residence.
